What are the four main stages of a divorce?

Ending a marriage triggers a large number of changes and requires making many complex and important decisions. From beginning to end, the process takes a minimum of six months, and includes the following basic requirements:

  • File the initial divorce petition with the court, deliver the official notice to the non-filing spouse and allow the non-filing spouse time to respond
  • Share financial information with the other spouse
  • Negotiate how to divide property and debts, parenting plans and spousal support terms, if any. The court will resolve these issues if an agreement cannot be reached
  • If a settlement is reached, file the final, signed agreement with the court and receive the final dissolution order

While the divorce process is relatively straightforward, there are many legal nuances that can affect your rights and options. We have extensive knowledge of California divorce law and will ensure you know what to expect at every stage so you can make informed choices.

How is child custody and visitation determined under California law?

Protecting your child’s wellbeing is always a top priority, and if you are contemplating divorce or separation, you need to understand your rights and legal obligations before you decide anything. In California, there are two types of child custody: legal custody and physical custody. Legal custody is the right to make important decisions relating to your child, and physical custody refers to the time the child spends with each parent. Spouses can work together to create their own parenting plan or turn the matter over to a judge if a settlement cannot be achieved. In either case, the court reviews the circumstances to issue an order he or she believes to be in the best interests of the child. Custody may be issued on a sole or joint basis. However, even in cases of joint physical custody, the youth might reside mostly reside with one parent due to the need for consistency in school and other activities. This order will govern the amount of parenting time or visitation the noncustodial parent receives. You need a strong attorney representing your interests in child custody matters, and we will fight to secure an appropriate outcome.
